1. Acceptance of Terms

By creating a profile, completing the onboarding process, or otherwise using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and FlowState. You also acknowledge that the App uses third-party analytics (PostHog) and subscription management (RevenueCat) services, as described in the Privacy Policy, to collect event data and manage your subscription.

2. Description of Service

FlowState is a personal discipline and productivity application designed to help you build consistent habits, complete structured flows, track goals, and maintain daily streaks. The App provides tools for self-improvement and is not a substitute for professional medical, psychological, or financial advice.

2.1 Subscriptions

FlowState offers premium features through a paid subscription. Two plans are available: a monthly subscription at $4.99/month (no free trial) and an annual subscription at $29.99/year which includes a 3-day free trial for new users. For the annual plan, your payment method will be charged $29.99/year after the 3-day trial period unless you cancel at least 24 hours before the trial ends. For the monthly plan, you are charged immediately upon subscription. Subscription payments are processed through the Apple App Store or Google Play Store, and are subject to their respective terms.

2.2 Cancellation

You may cancel your subscription at any time through your device's app store subscription settings or through the App's Settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.

3. User Obligations

By using the App, you agree to:

• Provide accurate and truthful information when creating your profile.
• Use the App only for lawful purposes and in compliance with all applicable laws and regulations.
• Not misuse, reverse-engineer, decompile, or attempt to extract the source code of the App.
• Not use the App to harass, abuse, or harm others.
• Not interfere with or disrupt the App's functionality or servers.

4. Intellectual Property

4.1 Our Intellectual Property

The App, including its design, graphics, code, logo, name, and all related content, is the exclusive intellectual property of FlowState and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

4.2 Your Content

You retain ownership of the content you create within the App (goals, habits, flows, etc.). Your content is stored locally on your device and is not transmitted to our servers. By using the App, you grant us a non-exclusive, royalty-free license to use anonymized and aggregated analytics data (such as onboarding option selections, screen views, and button interactions) for the purpose of improving the App. We do not collect or transmit the free-text contents of your goals, habits, flows, or profile fields to our analytics provider.

5. Limitation of Liability

5.1 No Warranty

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5.2 Limitation of Damages

To the fullest extent permitted by applicable law, FlowState shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory.

5.3 Cap on Liability

In no event shall FlowState's total liability to you for all claims exceed the amount you have paid to FlowState in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

6. Disclaimer

FlowState is a self-improvement tool. It does not guarantee specific results or outcomes. Your success depends on your own effort, consistency, and circumstances. The App is not a medical device and does not provide health, financial, or legal advice. Always consult qualified professionals for such matters.

7. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or engage in conduct that we deem harmful to the App or other users. Upon termination, your right to use the App will cease immediately. You may stop using the App at any time by deleting it from your device.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Delaware.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms within the App and updating the effective date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
